TERMS & CONDITIONS
Introduction
1. The promoters of this promotion “2023 Local Experience Package Competition” (“Promotion”) are Quest Serviced Apartments Pty Ltd (ABN 25 119 523 483) of Level 21, 390 St Kilda Road, Melbourne 3004, Victoria (“the Promoters”).
2. These terms and conditions (“Terms and Conditions”) govern the Promotion.
3. By participating in this Promotion, the entrant accepts these Terms and Conditions.
4. The Promotion commences at 12:00am Australian Eastern Standard Time (AEST) on 1 February 2023 and closes at 11:59pm AEST on 30 April 2023. (“Promotion Period”).
5. Headings in these Terms and Conditions are included for ease of reference and do not affect interpretation in any way.
Eligibility
6. This Promotion is only open to Australian residents aged 18 years or older who are not contractors of the Promoters, or the immediate family members of any such directors, franchisees or contractors.
7. Immediate family includes any of the following: spouse, de-facto spouse, child or step-child (whether natural or by adoption), brother, sister, parent, step-parent.
8. To be eligible, entrants must, during the Promotion Period:
i. Book a stay at a Quest Apartment Hotel in Australia using the promotion code ‘LOCAL23’; and
ii. Stay at the Quest Apartment Hotel (as booked in accordance with clause 8(i) above.
(“the Book and Stay”).
9. The prize draw is open to any eligible entrant who completed the Book and Stay within the Promotion Period.
10. Entries in any other form will not be accepted.
Entrant consent
11. By entering the Promotion, each entrant agrees that:
i. the Promoters may publish the entrant’s name as the winner of the Prize in any forum that the Promoters choose; and
ii. the entrant will participate in any publicity accompanying or resulting from this Promotion in printed and/or online formats for an unlimited period of time without remuneration for the purpose of promoting the Promotion, the Promoters or the products and services of the Promoters.
Determining and notifying the winner
12. This Promotion is a game of chance, and 1 winner will be drawn at random. The winner of the Prize will be selected by the Promoters using an online random number generator.
13. The Promoters’ decision concerning any aspect of the Promotion is final and no correspondence will be entered into.
14. The draw will take place at Quest Serviced Apartments Pty Ltd (ABN 25 119 523 483) of Level 21, 390 St Kilda Road, Melbourne 3004, Victoria.
15. The winner will be contacted via email or telephone on 1 May 2023 and provided with details of how to redeem the Prize.
16. The Promoters take no responsibility where they are unable to contact the winner who has not provided correct or complete contact details. If an entrant’s contact details change during the Promotion Period, it is the entrant’s responsibility to notify the Promoters. A request to modify any entry information should be directed to the Promoters.
17. If the Prize is not claimed within 72 hours of the Promoter contacting the winner, the relevant winner’s entry will be deemed invalid and the Promoter will be entitled to reselect the winning entry.
Prize
18. The winner will receive:
i. One (1) two-night stay in a studio apartment in a Quest apartment hotel (“Quest Hotel”); and
ii. One curated local experience.
(“the Prize”)
19. The Prize must be taken as stated. While the Promoters will consult with the winner as to their preferred Quest apartment hotel, dates and curated local experience, this will be subject to availability and other conditions, such as black-out dates, and the Promoters reserve the right to determine the specifics of the Prize at their absolute discretion. The Prize or any unused portion of the Prize is not transferable or exchangeable and cannot be redeemed for cash. The Prize is not valid in conjunction with any other offer. No compensation will be payable if the winner is unable to use the Prize as stated.
20. If the Prize is unavailable, for whatever reason, the Promoters reserve the right to substitute the Prize for a prize of equal or greater value and/or specification, subject to relevant laws. The Promoters accept no responsibility for any variation in prize value (including between advertising of the Promotion and redemption of the Prize).
21. Once a Prize has been awarded and claimed by the winner, the Promoters will not be responsible for any prize that has been lost, stolen, forged, damaged, or tampered with in any way.
Claiming Quest Prize
22. The Prize must be redeemed within 1 year and will be arranged by the Promoters in accordance with clause 19.
23. Upon arrival at the Quest Hotel, the winner will be required to:
i. provide reception with a current driver’s licence or passport to verify identity;
ii. provide reception a valid credit card for security purposes; and
iii. sign the Quest Hotel registration form and accept the Quest Hotel terms and conditions of stay.
iv. The check-in time will be 2pm unless otherwise arranged with the Quest Hotel. Should the winner intend to arrive at the Quest Hotel after 5pm, after-hour arrangements must be made with reception prior to arrival. On check-in, a security bond of up to $300 will be put on hold on the provided credit card to indemnify the Quest Hotel in the case of any breakage or damage during the stay.
24. The winner will be responsible to pay for any ancillary or incidental costs which may arise or are incurred as a result of winning the Prize including but not limited to any costs related to transport and car parking costs, food and beverages, entertainment and activities, and Wi-Fi internet access.
Limitation of liability and variation of promotion
25. Except as otherwise required by law, if any act, omission, event or circumstance occurs, including but not limited to vandalism, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, pandemic or government imposed travel restrictions, which is beyond the reasonable control of the Promoters and which prevents or significantly hinders the Promoters from complying with these Terms and Conditions, the Promoters will not be liable for any failure to perform or delay in performing its obligations. The Promoters reserve the right (subject to any applicable law) to cancel, terminate, modify or suspend this Promotion and these Terms and Conditions.
26. Except for any liability that cannot be excluded by law, the Promoters, its related bodies corporate and their respective officers, employees, contractors, franchisees and agents will not be liable for any losses (including loss of opportunity), damages, expenses, costs or personal injuries arising out of or in connection with this Promotion, or the use of any Prize and the entrants release and indemnify the Promoters from and against all actions, claims and liabilities, that the entrant now has or in the future may have against the Promoters for any loss, damage or injury (including any special or consequential loss) suffered as a direct or indirect result of the entrant’s participation in the Promotion.
Privacy
27. The collection and disclosure of any personal information provided in connection with this Promotion will be handled by the Promoters in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
General
28. The Promoters will not be responsible for any entries that are not received for any reason within the Promotion Period whether lost, delayed, corrupted or otherwise due to any technical difficulties or malfunctions.
29. The Promoters may in their absolute discretion not accept a particular entry or may disqualify an entry without giving reasons and without liability to any entrants. Without limiting this the Promoters reserves the right to verify the validity of entries, Prize claims and entrants and disqualify any entrant who submits an entry that is misleading or not in accordance with these Terms and Conditions or who manipulates or tampers with the entry process. In the event the winner breaches these Terms and Conditions, the winner will forfeit the Prize in whole and no substitute will be offered. Verification is at the discretion of the Promoters, whose decision is final. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
30. The Promotion and these Terms and Conditions will be governed by the laws of Victoria, Australia.
